Конституционализация гражданского права и ее влияние на правовое регулирование имущественного оборота

The institutionalization of civil law is carried out mainly through the interpretative activity of the Constitutional Court of the Russian Federation, which covers not only civil legislation, but also law enforcement activities and civil doctrine. The article reveals the main functions of this activity, namely: clarification by the Constitutional Court of the Russian Federation of the normative content of civil law categories, expansion of the content of civil concepts, identification of the purpose of traditional civil law institutions, influence on the emergence of new institutions in civil law. The article analyzes both the advantages of institutionalization of civil law in terms of the needs of property turnover, and some of the risks that accompany this process.
