Открытые лицензии с позиции участников сделки
In the article by V.N. Sinelnikova – doct. of legal sciences, Prof. National Research University Higher School of Economics, Prof. Department of Private Law, Faculty of Law (Moscow, vsinel@hse.ru ), the problematic aspects of open licenses are analyzed, including taking into account the rights and interests of authors of works and other copyright holders; the author's position on the practical value and social significance of a simplified way of concluding agreements on the terms of open licenses, the subject of which are exclusive rights to works, is formulated; for the effective use of open licenses in the interests of authors and other copyright holders, as well as potential licensees, it is proposed to allocate a special type from accredited non-profit organizations for the collective management of copyright and related rights, recognize the activities of such organizations as social entrepreneurship and extend the regime of socially oriented non-profit organizations to them, which will allow establishing mutually beneficial legal relations for the parties to the open license.
