The article raises the problem of the importance of unambiguous interpretation the concept of defect used in the implementation of contractual and non-contractual relations in construction. The relevant concepts of defect are considered in the framework of Russian, European and international sources (ISO 9000: 2015, Council Directive 85/374 /EEC, etc.). As the result of research, the most universal content of the concept of defect is proposed.
