Российские «контрсанкции» как современная форма реторсий
Abstract: international economic sanctions, having become an integral part of modern political and legal life, have caused the formation of a new legal reality in Russia. Responding to the challenge of «unfriendly» states, a whole layer of «counter-sanctions» norms has formed in the Russian legal order. Within the framework of this article the author explores the nature of «counter-sanctions» in the context of private international law, namely, comparing them with the institute of retorts. The author concludes that retorsions, as an institution of private international law, are aimed at balancing the rights and interests of their own citizens, legal entities and foreign persons, while, in order to restore the disturbed state, it is possible to deviate from compliance with the principle of proportionality of retorsions.
