The article deals with the right of individual entrepreneurs to compensation for moral damage caused by the dissemination of false defamatory information about the entrepreneur. The author believes that the provision of paragraph 6 of Resolution No. 33 “Concerning the practice of application by courts of laws on compensation for moral damage” of the Plenum of the Supreme Court of the Russian Federation dated November 15, 2022, stating that the rules for compensation for moral damage do not apply to protect the business reputation of entrepreneurs is erroneous because registering a citizen as an individual entrepreneur does not eliminate his/her biological nature, does not eliminate his/her ability to experience physical and moral suffering and does not derogate from his/her legal status as a citizen.
