Современные пределы деликтной ответственности: изменение климата и деликтное право
This article examines the prospects of using Russian tort law to compensate for harm caused by climate change. Drawing on a comparative analysis of case law from Germany, the Netherlands, and the United States, it demonstrates that climate-related disputes are increasingly falling within the scope of tort law. Particular attention is paid to the transformation of the traditional elements of tort liability, including harm, causation, and wrongfulness. The article argues that Russian law generally possesses the necessary legal tools to address such claims, including actions for damages, preventive injunctions, and product liability claims. It also explores the theoretical foundations of climate liability from the perspective of corrective justice and concludes that the principal challenges lie in adapting existing legal doctrines to the distinctive features of climate-related harm.
