Государство и право Улуса Джучи (Золотой Орды и ее наследников) в юридических исследованиях: тенденции и перспективы
The purpose of the article is to analyze the state of legal research on the state and law of the Jochi Ulus, that is, the Golden Horde and its heirs, the Turkic-Mongolian states; to identify the reasons for the insignificant attention of jurists (legal historians) to this issue; to identify the main trends and prospects for studying the political and legal history of the Jochi Ulus from a legal point of view. The reasons why legal scholars pay little attention to the state and the law of the Jochi Ulus are the absence of a significant number of legal monuments for historical and legal analysis and the need to know the specifics of traditional Oriental law in general and Turkic-Mongolian in particular. Lacking such knowledge and often relying on the Eurocentric model of the history of the state an law, those lawyers who conduct such research make many mistakes in their research. Also, lawyers who turn to the state and the law of the Jochi Ulus often have no idea about the current state of research on its history, about the sources introduced into scientific circulation, etc. Based on the results of the study, recommendations were developed to use an interdisciplinary approach more actively, to interact with specialists in related fields (historians, orientalists, etc.), as well as to pay attention to the analysis of individual branches of law and legal monuments.
