Civil law operates under the principle that publicly available information, unless specifically prohibited, may be freely used and distributed by anyone (without permission) and without compensation. Only non-public, confidential information has economic value and, accordingly, can be commercially traded. The legal system contains a number of institutions: confidentiality of information, restrictions on access to information and know-how, and the protection of confidentiality (non-public availability). However, once the regime of access restriction or secrecy has been violated, returning the previously protected data to its original state of obscurity and prohibition on its use is impossible. Thus, information, data, and content are extremely fluid, inherently striving for free dissemination.
