Правовой режим объектов, созданных искусственным интеллектом: обзор зарубежной практики
The article examines the legal regime of intellectual property created by artificial intelligence. Changes to the existing legal framework towards recognizing artificial intelligence as a legal entity would violate the rationale and fundamental principles of the intellectual property rights system. This article provides an overview of different views on the rationale for granting copyright to works created by artificial intelligence. The author notes that in some jurisdictions, copyright has already been granted to such works; however, in most cases, even the most progressive legal systems are not ready to recognize artificial intelligence systems as subjects. The author concludes that Russia should demonstrate leadership in creating a global system of technology regulation, protecting the supremacy of law, social, economic and cultural rights, and technological sovereignty.
