Историко-правовой анализ становления и развития этапов платы за землеустройство (с 1917 года по настоящее время)
Introduction: the article is devoted to the analysis of the legal regulation of land management fees for more than a century of its development, which showed the dynamics of its changes in different time intervals. The payment for land management was at all periods of the existence of the Institute of land management itself. The changing political system showed only the specifics of its legal regulation. Today, in modern Russia, there is a twofold situation with the payment for land management: on the one hand, it is not mentioned either in the Land Code of the Russian Federation or in the Federal Law "On Land Management", on the other hand, such a fee exists and is issued depending on the customer of the work, which creates a certain gap in the settlement of this institution. On the eve of the adoption of the new law "On Land Management", it is necessary to analyze the historical path of development of land management fees, from the point of view of analyzing its positive and negative features. Purpose: based on the analysis of legal regulation, to determine the need to regulate land management fees by the norms of current legislation. Methods: historical, logical, comparative legal, structural and functional. Results: it is proved that the formation of land management fees went through three independent stages: the first stage arose before the revolution, but we identified it as the genesis of the topic under consideration, which was taken as a basis by the Soviet government; the second stage is determined by the historical framework of the period from 1917 to 1990 inclusive, i.e. at the time of the land reform; The third stage is the period after the land reform and up to the present.
Conclusions: it has been established that there is a direct link between the financing of land management fees from the relevant budget and the performance of the public function of the state to manage the country's land fund. The hypothesis is substantiated that the payment for land management should be included as an independent element in the payment for land through legislative consolidation.
