The scope of a public contract remains extremely uncertain to this day. Within the framework of this study, an attempt was made to outline the possible boundaries of this institution. As a result, the author came to the conclusion that there are four signs of a public contract, including: the specific nature of the activity of the obligated person; carrying out this activity in relation to everyone who applies; special requirements to the participants both on the side of the obligated person and on the side of the authorized person. The first part of this article examines Russian legislation, which reflects the institution of a public contract; German experience; as well as one of the signs of a public contract, namely: the nature of the activity of the obligated person.
