Теория юридической аргументации. Опыт критического осмысления.
The article formulates the modular conception of discourse. On this basis, coordinating conjunctions and connectors are opposed as relational elements of syntactic and pragmatic discursive modules respectively. Conjunctions connect syntactic unities (members of sentence, sentences, etc.), while connectors relate pragmatic components (speech acts, moves, etc.).
The development of the ideas of argumentation in the Ancient World was closely connected with the formation of logic as a science of thinking, as well as the development of oratory. The presence of constant rhetorical practice, during which the most effective methods of persuading speech influence were developed, stimulated the development of similar ideas of argumentation in the West and in the East, despite a different understanding of anthropological perspectives in ancient and eastern philosophical traditions. Today, the teachings on argument, public speaking and proof, created in antiquity, are regarded by researchers as the beginnings of a theory of argumentation.
The article is devoted to the study of the theological article as a representative of theoretical theological discourse. In the article, the determinants of this kind of discourse are singled out, determinants viewed as its key features enhancing the argumentative effect.
The report addresses the methodological challenge of studying judicial reasoning in a Codified Systems of such Western countries as France and Germany in the 19th century and Russia in the late 19th early 20th century. The difference in style of Western European and Russian decision should be explained by taking into account national legal consciousness along with black letter rules of the codes and statutes.
The present research addresses the phenomenon of recurrence at structural, semantic and metatext levels and aims to analyze its impact on the author’s argumentative line and text identity. The paper focuses on the use of prospective and retrospective iteration that plays a particularly significant role in scholarly literature where an academic text is due to comply with specific regulations and to report on the research results in the most objective way. To achieve the goal academic writers rely on employing a system of concepts typical of a particular science, providing unquestionable arguments and critical approach to convince the readers and win their trust. Scholarly articles related to management studies have been exposed to content analysis methodology and the findings reveal that recurrence as a multifunctional phenomenon is an integral part of narrative since it structures the composition, discloses the author’s intention, supplements well justified reasoning through clarification, interpretation, explanation, accentuation and contributes to text consistency, cohesion and coherence.
