The modern system of contractual relations is saturated with a variety of   terminological apparatus, which has not yet been defined. The terms “public tenders” and “purchases”, as well as other terms related to the contractual system, are often not clearly defined, do not have the main features distinguishing them from each other. At the same time, the legislation of the Russian Federation does not provide an exhaustive definition of these concepts. Studies of these definitions are very diverse and far from unity, which may indicate recognition of the institute of state and municipal procurement in the Russian Federation as an integrated institution requiring the establishment of a clear system of terminological apparatus, certainty in recognizing the legal nature, the establishment of specific features of the source base.
