Индукция, аналогия, интуиция в конституционно-судебном познании: попытка логико-правового исследования
В настоящей работе, также как и в двух, опубликованных ранее в настоящем издании, автор обращается к проблеме аналогии в конституционно судопроизводстве. При этом основной акцент делается на соотношении этого метода познании с иными, известными традиционной логике: дедукции и индукции. Одновременно устанавливается его место в российской конституционно-судебной практике в сравнении с англо-американской и континентально-европейской.
The article focuses on investigation of personal attitudes toward oppositions of life. This research is following the principles of psychology of personal life attitudes and cultural psychology of personality. Some ways of explication of psychological knowledge about intuitive and reflexive personal attitudes to oppositions from cultural sources are suggested. As a data for hermeneutic analysis, texts of folk tales and Renaissance self-cognition text are provided. Author concentrates on self-developing and self-forming aspects of personal attitude to life oppositions.
The present manual is written on the basis of the course on inductive logic which is delivered in English to philosophy students of National Research University Higher School of Economics. The manual describes the main approaches to constructing inductive logic; it clarifies its key notions and rules, and it formulates its major problems. This introductory text can be useful for all readers who are interested in contemporary inductive logic.
The essay on thinking of thinking. The article is motivated by the 80-th birth anniversary of outstanding psychologist and pedagogue V.V. Davydov who was engaged, in collaboration with D.B. Elkonin, in elaboration of psychological foundations and pedagogical practices of developing education. The program he has devised focused on the advance of schoolchildren’s capacity for theoretical thinking and formation of readiness, inclination and capacity for conceptual thinking. An attempt to apply V.V. Davydov’s ideas to analysis of the thinking per se is made. Special attention is given to reflexion and intuition.
The article is devoted to the 80th anniversary of the prominent psychologist and educator - V. V. Davydov, who (together with D. B. Elkonin) has developed psychological base and pedagogical practices of the developing education. The main focus of the elaborated program was the development of theoretical thinking and the formation of readiness to thought and the ability for conceptual thought among school children. The article is an attempt to apply conceptualizations developed by V.V. Davydov to the analysis of thinking as such.The greatest attention is given to reflection and intuition.
The article is devoted to a particular form of freedom of assembly — the right to counter-demonstrate. The author underlines the value of this right as an element of democratic society, but also acknowledges the risk of violent actions among participants of opposing demonstrations. Due to this risk, the government may adopt adequate measures restricting the right to counter-demonstrate, certain types of which are analyzed in this paper.
Development of standards of international controllability is reviewed in the article. Institutional approach is applied to development of international legal regime of Energy Charter. Definition of controllability is connected to development of international standards of dispute settlement, which are described in the article in detail. In connection with controllability, Russian interest, defense of investment in European Union and ecological investment encouragement, is reviewed in the article.
