Правовой реализм Оливера У. Холмса: учение об онтологии прецедентного права
Oliver Wendell Holmes, Jr. (1841-1935) was an outstanding American jurist, who served as an Associate Justice of the US Supreme Court from 1902 to 1932. The history of legal doctrines regards him as a founder-father of a sociological and realistic schools. His ideas and observations developed by followers of legal realism and sociological jurisprudence founded a new understanding of law and answered many questions that considered for a long time as insoluble within the concepts of formalism, positivism, normativism and natural law.
The monography presents not only a contextual analysis of O.W. Holmes' legal thought, but also a legal translation of many authentic texts of his works that have not been previously studied in Russia.
