P.VII.1.3 и его источники: к вопросу о технике работы составителей «Семи Партид»
In the article are reconstructed the sources of the law P.VII.1.3 from the “Siete Partidas” of Alphonse the Sage (1252 – 1284) and made some observations about legislative technics of the Castilian jurists. Author has affirmed that the legists of Alphonse X had used as a sources some fragments of book IX of Justinian Code, of book LXVIII of Justinian Digest and – perhaps – of book IX of Theodosian Code. Also has noted that the Castilian legists, from one side, had used the Justinian Corpus without call its texts in question but, from another side, had done it very freely. The last is not usual for work of medieval jurists, according to classical historical conceptions.
L'objet de cet article est l`analyse comparative des problèmes de la réglementation juridique de l`activité médicale (incluant la médecine traditionnelle) et la responsabilité pénale pour l'exercice illégal de la médecine et pour les autres infractions en France et en Russie.
The article considers the features of the presumption of knowledge of criminal law rules as a condition of guilt and responsibility for crimes in the sphere of economic activity. It argues conclusions on the ways to improve the organization of legal education of population, as well as the system of legal training of the staff engaged in economic structures and in respect of their penal control officers of the relevant legal institutions. It also justifies the relationship between the strengthen of the presumption of knowledge of criminal law in relation to these crimes with an increase in the effectiveness of criminal justice in the relevant field, and hence the efficiency of the economic activity.
