Общие принципы урегулирования несостоятельности
Resolution of insolvency is a fairly wide range of different, and not only rehabilitation and preventive procedures, but also liquidation, which have their own characteristics depending on the type of insolvency, the size of the estate and its structure, as well as the position of the debtor in the competitive market. What are the features of each procedure, what are the similarities and differences between the rehabilitations carried out in relation to representatives of markets with almost ideal competition and oligopolists, which must be taken into account when settling careless (wasteful) insolvency in the process of restoring solvency? These and many other issues will be considered in this dissertation in order to demonstrate the heterogeneity of the institution of insolvency and the destructiveness of applying only one procedure to all subjects under any circumstances.
