Региональное штрафование за склонение к абортам: ограничение репродуктивного выбора или врачебного информирования
Over the past year, several regions of Russia have introduced fines for inducing pregnant women to have abortions, namely: the Republic of Mordovia, Tver Oblast, Kaliningrad Oblast, Novgorod Oblast, Kursk Oblast, Pskov Oblast, Vologda Oblast, Smolensk Oblast, and the Komi Republic. In law enforcement practice, there may be clashes between regional innovations that do not properly exclude the comprehensive medical information guaranteed by Federal Law No. 323 from the effect of the administrative norm, and federal sanctions under Article 6.32 of the Code of Administrative Offenses of the Russian Federation, where doctors were and are subject to punishment and fines for violating the procedure for informing and the timing of an abortion at the request of a woman and for medical and social reasons. It also appears that the regional application of fines for inducing artificial termination of pregnancy and the simultaneous introduction of the "Bethlehem certificate" (financial incentives for obstetricians and gynecologists for refusing abortion) will lead to the degeneration of the medical confidentiality regime, on the one hand, and, on the other hand, will hinder the full and comprehensive information of patients in the situation of reproductive health and choice. The paper presents regional innovations on restrictions on artificial termination of pregnancy and their negative impact on medical functionality and information, medical confidentiality, patient compliance and trust.
