Общая теория конституционной конфликтологии
The monograph presents the results of a long-term study of various conflict manifestations in constitutional law: competition of constitutional values, constitutional conflicts and ways to resolve and prevent them. The author proposes to consider the general theory of constitutional conflictology as a new branch of the science of constitutional law. Constitutional law has historically been formed under constitutional conditions conflicts in order to resolve the most important confrontation between the individual and the state. Constitutional law initially bears this “conflictological imprint”, and each state, in its constitutional acts, independently determines ways to prevent and resolve such conflicts.
Constitutional conflicts are studied by the author not only from the standpoint of a formal legal approach, but also with the involvement of other sciences: sociology, psychology, conflictology and economics. The monograph also contains various empirical data on constitutional conflicts in Russia and foreign countries, analyzes the experience of legislative regulation of foreign countries, certain aspects of the constitutional reform of 2020 in Russia.
