Family Law and Violence: The jurisprudence of the European Court of Human Rights

The European Convention on Human Rights, although it refers to children in several places, does not contain provisions that specifically address children’s rights. At the same time, the Convention, while requiring the Contracting Parties to "secure to everyone within their jurisdiction the rights and freedoms defined” in the Convention, applies both to adults and children. Indeed, there are a lot of applications that have been filed on behalf of children by their parents or other legal representatives, and by now, European Court has developed a vast jurisprudence on children’s rights. The paper focuses on issues related to family and violence that fall within three Articles of the Convention: 2, 3, and 8.
