The main thesis of the work is the assumption that the making and motivation of court decisions in the cases of the mentioned category can be explained — among other reasons — by the difference of the initial worldview of judges, given the prevailing legal education and discourse approaches. These guidelines do not completely prejudge decisions and their justification, since here considerable importance also belongs to the personal characteristics of specific judges.
