In modern civil law, two views coexist regarding the meaning and nature of person’s
identity. On the one hand, with the recognition of human value (not economic), many
legal systems have entrenched a view of the special nature of person’s identity, it’s
inalienability, and close connection to the individual. So, the idea of the use of person’s
identity for purposes of trade has become the target for criticism. On the other
hand, a person’s identity is becoming a subject for commodification. But the traditional
legal view of person’s identity does not consider its commodification. So, the risk of
violation of person’s identity increases significantly. The article proposes a concept of
a civil law regime for person’s identity that could address this issue.
