Санкционный правовой режим как основание для расширения пределов вмешательства государства в конституционный принцип свободы экономической деятельности в Российской Федерации
One of the most important challenges for Russia at the current stage of its development is the unprecedented sanctions pressure from foreign countries, which began in 2014 and has been gaining momentum since 2022. The abundance of economic sanctions imposed on our country requires the state to develop measures to preserve the stability and sustainability of the domestic economic system in the face of emerging threats. In this regard, in order to ensure the economic security of Russia, the state adopts various counter-sanctions acts, which impose restrictions on the economic activities of business entities. The application of certain restrictions (for example, a temporary property management regime, a mechanism for the mandatory creation by the state of specialized legal entities to which all or part of the organization’s assets are transferred, the possibility of compensating property seized from the Russian Federation or the Central Bank of the Russian Federation at the expense of the property of the United States or related persons, as well as the suspension of corporate rights of foreign companies in economically significant organizations, etc.) may make it much more difficult, and sometimes even make it impossible to implement the principle of freedom of economic activity for some categories of business entities. At the same time, the possibility of applying these measures is due to the fact that the abundance of foreign economic sanctions directed against Russia, along with internal counter-sanctions measures, have actually formed a new form of extraordinary legal regime in our country, which can be called a sanctions legal regime. Under this regime, by analogy with other extraordinary legal regimes, there is an expansion of the limits of state intervention in the implementation of the most important constitutional rights and freedoms (in this case, in the implementation of the constitutional principle of freedom of economic activity and the principle of freedom of entrepreneurship derived from it).
