Новые подходы к охране авторских прав в сети Интернет в цифровую эпоху
Relevance. The development of digital technologies can help to solve the problem of copyright protection on
the Internet. In particular, such potential is demonstrated by the distributed ledger technology, which allows to ensure
the turnover of copyrights through the conclusion of smart contracts and record the use of copyright's objects and
thus prevent violations in this area. However, in the absence of proper legal regulation, the use of digital technologies
carries risks that must be taken into account in the process of improving copyright standards.
The purpose of the study is to evaluate new approaches to copyright protection on the Internet that are arising in
connection with the development of digital technologies and are common for different national legal systems.
Objectives: to analyze the potential of digital technologies in the mechanism of copyright protection on the In-
ternet; to identify possible risks of their use; to formulate proposals for improving Russian legislation taking into ac-
count these risks.
Methodology. The research used methods such as comparison, analysis, generalization, induction and deduc-
tion, as well as private scientific methods – comparative analysis and a systematic approach to the study of the prob-
Results. The potential of distributed ledger in the field of copyright protection is related to its ability to store and
maintain data in the registry by network users without the mediation of a single control center and to record the use of
copyright objects on the Internet, and tokenize these rights.
Conclusions. Modern types of distributed ledgers are not able to cover all the resources of the network and
therefore the problem of copyright protection cannot be solved without improving the technology. In addition, a num-
ber of problems can be eliminated by providing distributed ledgers of the intellectual property rights with a function
that allows state registration of tokenized exclusive rights if this is provided for by law.
