О понятии инвестор

The investor is one of the most important figures in the investment process. In a significant part of cases, he is the initiator of investment, since the fate of a particular investment project depends on his decision to invest. Investment legislation quite often operates with this term, while there is no common definition in it. In particular, the analysis of investment legislation demonstrates the existence of various definitions of the concept of investor (for example, a foreign investor, a resident of a special economic zone, a qualified investor, a depositor, a customer), which are used only in relation to a certain type of investment activity. Judicial practice and legal doctrine on this issue are not stable and unambiguous.
As a result of the research, it is stressed that the investor is the person making the investment, i.e. such an entity that has decided to convert its savings into a legal investment regime in pursuit of a specific goal. Such aim is quite variable, in particular, it can be associated with both making a profit and also be aimed at achieving some other significant result for the investor. Speaking about the investor as a generalized category, it should be noted that for regulation, it doesn’t matter what type of legal entities it is, what it’s nationality and types of objects are invested, on what right the invested property belongs to it.
