ГЕННЫЙ ДОПИНГ В СПОРТЕ: МЕЖДУНАРОДНО-ПРАВОВЫЕ ЗАПРЕТЫ И РАЗВИТИЕ БИОТЕХНОЛОГИЙ
The urgency of the topic of standing out against gene doping in sport rises along with technology development, as peculiarities of this kind of doping makes application of existing international legal methods, which are oriented towards doping of pharmaceutical nature, inefficient. The aim of the research is to identify the nature of this phenomenon, meaningful from legal point of view peculiarities of gene doping and directions of improvement of international legal mechanisms in the field of prevention and resistance. The goals of the research are to state peculiarities of gene doping in comparison with doping of pharmaceutical nature, to analyze provisions of international conventions against doping, the UNESCO Universal Declaration on the Human Genome and Human Rights, 1997, World anti-doping code in the context of gene therapy specific character and efficiency of regulation, to explore the development of approaches in the sphere of prevention and prohibition of gene doping and its inclusion to the WADA prohibited list, to assess international legal regulation in force and to suggest directions of its development. According to the results of the analysis of essential doping features, models of interference (therapy, improvements of different nature and level), trends of development, provisions of international documents in the sphere concerned a conclusion was made that over the gene doping was applied universal legal construction of doping resistance. Meanwhile, the gene doping distinguishes itself by a row of essential peculiarities, that stipulates the need in specific approach to the regulation. The concept of doping was analyzed in the context of its applicability to gene doping. The author made a conclusion that the adaptation of international legal regulation in the field of resisting doping to the new phenomenon in the field of gene technologies is needed.
