This article is the commentary on the decision of the Constitutional Court of the Russian Federation dated February 21, 2022 No. 7-P, which is largely devoted to the analysis of the concept of unfair competition and the issues of proportionality of the state response in order to counter this negative phenomenon. It seems that this act of constitutional justice not only resolved a specific applied issue of the conformity of the constitution with the current antimonopoly legislation, but, more importantly, crystallized the most important constitutional aspects that regulate the limits of state-legal protection of the economy, requiring in-depth scientific analysis, both from the standpoint of jurisprudence, as well as from the point of view of economics.
