Перспективы ратификации статьи 26 Европейской социальной хартии (право работника на защиту своего достоинства в период работы)
The article analyzes the prospects of ratification by the Russian Federation of article 26 of the European Social Charter. It is concluded that the existence of certain general norms in the labor legislation on the prohibition of discrimination, the right to dignity during work does not guarantee the protection of employees from harassment and violence in the workplace. The lack of definitions, a special composition of the offense "harassment", employers - mechanisms of influence on aggressors and special guarantees for victims make it difficult to advance the agenda of this article. An equally important task is to inform and raise awareness about the problem of violence and harassment in connection with work, provided for by the ECC. The article provides examples from a few judicial practice. Proposals were made to improve the current legislation.
