In order to counteract the criminal risks associated with the increasing spread of non-cash payments in economic activities and the corresponding electronic devices that form the infrastructure of these payments, the legislator changes the rules of the current criminal law, however, these changes can not always be called successful. Analysis of theoretical works and materials of law enforcement practice in terms of the qualification of the crime, the composition of which is provided by art. 187 of the criminal code of the Russian Federation, confirms the thesis about the need for a deeper approach to the criminalization of such acts and the need for a judicial explanation of the procedure for applying this rule.
