ВОЗМОЖНЫЕ ПУТИ ОСУЩЕСТВЛЕНИЯ МЕЖДУНАРОДНОГО ПРАВОСУДИЯ ДЛЯ СИРИИ
The article examines possible ways of implementing international justice for crimes committed in the Syrian Arab Republic. The possible alternatives are analyzed consistently: the creation of a separate international ad hoc tribunal, the referral of the case to the International Criminal Court, the establishment of hybrid tribunals in Syria with the participation of foreign judges, the conviction of war criminals by the national courts of foreign countries. Particular attention is paid to the quasi-judicial international impartial and independent mechanism for Syria. Reference is made to the experience of already established international criminal tribunals, in particular for Rwanda and the former Yugoslavia. A conclusion is drawn on the need to establish institutions for transitional justice on the long-suffering Syrian land.
