Административная ответственность и иные меры административного принуждения за нарушение антимонопольного законодательства: проблемы разграничения и соотношения в правоприменительной практике
This article examines the legal issues surrounding the distinction and correlation between restorative and punitive administrative enforcement measures for violations of antitrust legislation. It provides a critical analysis of the inadmissibility of issuing an order to transfer income received as a result of violating antitrust legislation to the federal budget when collecting a turnover-based administrative fine, as well as the possibility of such an order when applying a fixed-amount administrative fine for abuse of a dominant position in a product market, concluding an agreement restricting competition, or engaging in concerted actions restricting competition, and unfair competition. Possible solutions to these issues in the application of administrative enforcement measures for violations of antitrust legislation are proposed based on a risk-based approach and a cost-effective approach.
