This paper discusses issues related to the illegal participation of individuals in business activities. Special attention is paid to the difficulties of applying legal norms in the process of countering such offenses. In addition, the study analyzes the current Russian and foreign legislation regulating illegal participation in business activities. Studying various regulatory systems for illegal participation in business activities allows us to adopt best practices and take a closer look at the problem. The paper also examines the problem of illegal business conduct, including cases of lack of necessary permits, provision of illegal benefits, advantages, patronage. In addition, the author puts forward proposals to improve the legal framework, differentiate criteria and practice of its application, which will help strengthen the fight against shadow entrepreneurship and create more transparent conditions for economic cooperation.
