Злоупотребление процессуальными правами в контексте цифровизации правосудия
The development of information technologies in legal proceedings and their active introduction into the daily practice of courts in recent years raises the question of the risks of using such technologies by participants in legal proceedings for unfair purposes. The abuse of procedural rights known to traditional justice can also be carried out in the digital age; the task of procedural science, the law enforcer and the legislator at the present stage is to identify incentives and opportunities for potential inappropriate behavior and find responses to them that best meet the challenges of justice in the era of digitalization. In the article, taking into account the current judicial practice and legislation, two blocks of procedural abuses are analyzed – dishonest behavior when using videoconferencing systems (web conferences) and electronic document management. The authors described specific abusive actions of persons involved in the case in the field of electronic justice, developed means to minimize them with a proposal for the use of certain coercive measures. In general, the analysis demonstrated that digital technologies have great potential, opening access to justice to an increasing number of interested and needy persons. The process of digitalization cannot be regarded only as a source for new procedural risks and abuses. Informatization serves, among other things, as a tool for preventing procedural abuses through audio and video recording of court hearings.
