Национальные проекты в системе документов стратегического планирования: технология конструирования будущего
The article is devoted to the study of the legal nature and place of national projects in the strategic planning system of the Russian Federation. The relevance of the work is due to the increasing role of national projects as a key instrument of public administration. The authors examine the evolution of national projects from their inception to the present day, as well as analyze their relationship with other strategic planning documents. The paper uses formal-legal, historical-legal and comparative-legal methods. Based on the analysis of the Law on Strategic Planning, the Budget Code of the Russian Federation, and by-laws, the thesis is substantiated that national projects occupy a special place in the hierarchy of strategic planning documents that does not coincide with their formal level established by law. A retrospective look at the development of the state planning system suggests the formation of an interdisciplinary legal institute for strategic planning, within which there is a hierarchical system of goals and indicators, among which indicators of national projects will occupy the top level. The levels of legal regulation of strategic planning are highlighted: the legislative level, the level of acts of the President of the Russian Federation and the Government of the Russian Federation, the departmental level, as well as the regional and municipal levels. Special attention is paid to the problem of the correlation of strategic and financial planning. The authors conclude that national projects, not being normative legal acts, do not directly generate expenditure obligations of budgets. The complexity of the procedure for forming expenses for the implementation of national projects and government programs is noted. In conclusion, it is emphasized that national projects are a dynamically developing interdisciplinary legal institution synthesizing elements of forecasting, planning and goal-setting, and their legal form remains open for further improvement
