The article is devoted to the consideration of the criminal law experience of a number of foreign countries in terms of regulating the exercise of the right and the performance of the duty as circumstances, the presence of which correlates with certain legal consequences. At the same time, the experience of studying these grounds in the doctrine of domestic criminal law in the context of uncodified circumstances precluding the criminality of the act is touched upon.
