Духовные начала в результатах интеллектуальной деятельности с позиции российской правовой системы и православия

Law, Faculty of Law (Moscow, vsinel@hse.ru), legal criteria of conformity of the results of intellectual
activity and means of individualization to public interests, principles of humanity and morality
(spiritual principles) are analyzed and their epistemological aspect from the position of Orthodoxy
is presented. The point of view on the scientific value and social significance of the requirements
of the law on the conformity of the results of intellectual activity and means of individualization to
spiritual principles is formulated.
The authors of the article are convinced that from the Orthodox position in the field of humanitarian
knowledge, that intellectual achievement only has value, which contributes to bringing
a person closer to the knowledge of the truth, and at best – the appearance and development of
spiritual unity with God in a person. Works that cultivate different forms of evil or simply convey
the idea of sin as the norm are spiritual poison for people. Valuable humanitarian knowledge is
higher than valuable natural-scientific, medical and technical knowledge, since the former are able
to positively influence what cannot be higher in a person: his immortal spirit and eternal fate, while
the latter serve the physical existence of a person and/or satisfy the inquisitiveness of the mind
regarding the material world.
