ПЕНСИОННОЕ ОБЕСПЕЧЕНИЕ В ОБЩЕСТВЕ РИСКА: ПРАВОВЫЕ АСПЕКТЫ
Background . The relevance of the study is attributed to the changing system of interaction between the state, society and individual in a pandemic. Modern society is increasingly acquiring the features of a "risk society" described in sociological concepts developed at the turn of the 20th - 21st centuries. The study is aimed at identifying the features of the legal regulation of pension in a risk society. Materials and methods. The study is based on a universal dialectical method, which involves examining any object and phenomenon in the process of its formation and development in conjunction with other objects and phenomena. In addition, the study applies the general scientific methods (analysis, synthesis, systemic and structural), special scientific methods (sociological, historical) and special legal methods (comparative legal, formal legal). Results. The legal aspects of pension at the present stage are analyzed through the prism of sociological concepts of the risk society. The main approaches to understanding of social risk presented in the works of sociologists N. Luhmann, U. Beck, E. Giddens, as well as modern legal scholars and historians P. Rosanvallon, P. Saly, M. Borgetto are investigated. The main trends in the development of pension and social insurance in the risk society are revealed. Conclusions. The authors conclude that the restrictions associated with lockdowns, halted activity of economic entities, as well as suspension from work, entail long-term negative consequences for pension and insurance systems, consisting in the shortfall in contributions. The inevitability of further expansion of financing pension from budget (tax) sources is noted. An assumption is made about the transition to an unconditional basic income as the foundation for social security of the population.
