the article attempts to study the role of a lawyer in the collection of evidence in criminal cases of public prosecution and ways of "legalization" of the results of his activities.  In the course of understanding the changes in the criminal procedure code of the Russian Federation that have occurred over the past three years, the author came to the conclusion that they clearly indicate the appearance in the domestic legislation of the first signs of the birth of the Institute of legal investigation. At the same time, there are still many unresolved problems in this area, some of which the author has focused on.
