This paper is focused on the methodology of the political and legal project of modern Italian philosopher Giorgio Agamben. While addressing Agamben’s methodological presuppositions and strategies this paper raises the question whether they are applicable to the methodology of legal studies. We presume that in methodology of legal studies there is a certain caesura: the constant need to distinguish its object – law – from other social phenomena, i.e. politics and religion, creates for legal studies blind spots where law becomes undistinguishable from these phenomena. To overcome this, we propose to address Agamben’s philosophical approach, which radically brings together legal, political and religious traditions of the West. In order to get a view of methodological foundations of his critique of Western tradition, we will examine his theses on the connection between law, politics and religion as well as his strategy of profanation and problem of salvation which is closely connected with it, since by these two concepts Agamben conceives the overcoming of problems and paradoxes our tradition faced.
