The article analyzes the law on Advocacy for the use of customs in ensuring the adequate protection of the court, and the formation of evidence. According to the author, lawmaker and law enforcer using the formula “the custom» everywhere, so it is recognized not only the importance but also the need of a legal instrument to regulate the civil turnover. Parties actively used trade usages. In addition, now the number of calls with questions unsettled by law or contract, has increased and requires clarification.
