The article is devoted to the issues of legal regulation of social and cultural sphere of the Russian society. In particular the issues of preservation and state protection of monuments of history and culture (cultural heritage) in the Russian Federation are considered. The ratio of state authority’s powers of Russia and the constitutional entities of the RF in the sphere of preservation and protection of cultural heritage has been studied. Attention is focused on transferring the state powers from the public authorities of the Federation to the public authorities of constitutional entities of the Russian Federation (regions) and the compliance of such transferring to the Russian Constitution. Special attention is paid to the state control in cultural heritage protection sphere. It is concluded that it is necessary to improve the mechanism of protection regulation of cultural heritage in Russia and to fill gaps in the law.
