Некоторые конституционно-правовые аспекты экспериментального правового регулирования
The paper considers legal experiment (special legal regime) from the point of observing constitutional norms in its course. While there are no doubts as to conceptual possibility to conduct a legal experiment observing the principle of equality, the author suggests criteria that should be observed so that experimental legal regulation and legal regulation of the order of conducting legal experiments would not contradict this principle. Also, the author warns against excessive legal experimenting where it is not necessary to develop legal framework, as well as against application of the term “experiment” to describe something that is essentially establishment of new regulations; otherwise, the realisation of the principle of supporting trust in law and actions of state could appear problematic. The legal experiment is also considered in terms of observance of order, conditions and limits of the hierarchy of normative legal acts during its conduction, as well as observance of the established differentiation of powers among the levels of public authority. The author believes that in regulating experimental legal regimes the reasonable balance can be found allowing on the one hand to ensure observance of this requirements, and on the other hand not to call into question the real possibility to conduct a legal experiment.
