The paper presents the concept of the legal status of shareholder’s spouse. It is demonstrated that during the joint marital property regime on shares a spouse, not being a shareholder, enjoys only property rights which is effectively a right to value (price) of a shareholding, but they have no lawful interest in corporate rights and corporate control. It is argued that the current approach to the acquisition of a shareholder status by a spouse is based on the erroneous understanding of the transfer corporate rights to them, hence, with the use of comparative studies more efficient mechanisms to dissolve of the marital property on shares are proposed.
