Финансовое право в условиях развития цифровой экономики
The collective monograph deals with actual problems related to the development of financial law in the light of emerging digital economy. The dynamics of the development of the most important financial law institutions in the conditions of the formation of the digital economy is considered.
The legislation is as of October 1, 2018.
The monograph will be of interest to researchers, postgraduates, undergraduate and graduate students, researchers specializing in financial and legal regulation.
The most corresponding to the needs of Russia of 1990s was a hybrid of Swiss and Chinese model, ideally combining advantages of both capitalism and socialism. That variant is also good today, it's basic feature is security of business undertaking from encroachments. But within the circumstances, business should take care of its safety itself. To put business under control, it is divided into loyal, "bog" and protesting. Entrepreneurs represent a very small part of the society, though they serve to take Russia to the other bank of the river - to advance-guard of the world civilization. It is necessary to mention that this country makes its third attempt to transform its economy into the market one. The first two were not successful because of not sufficient care of the state about business and entrepreneurs. First of all, it is necessary to cut state power off business and vice versa, and then to heighten the level of education of staff involved into business. The bases of criminal safety of business should be paid much attention. The object of criminal safety of business is business undertaking, property and businessmen. Criminal safety of business is its protectability from criminality by means of physical, managerial and law security.
The work is devoted to the topical issues of practical implementation of digital transformation services in the economic processes of transport, foreign and mutual trade in the digital economy. The authors analyze the strategic planning documents adopted recently in the EAEU countries, which provide for measures aimed at stimulating the development of digital technologies and their use in various sectors of the economy, including the program "Digital economy of the Russian Federation". Emphasis is placed on the fact that there is no definition of "digital economy" in the approved policy document, which focuses on the development of purely infrastructural elements of the new economic order. The authors, noting the service nature of the transport industry, propose a new principle of priority implementation of innovative digital management mechanisms in transport processes: first, the construction of new digital services, then - the creation or integration of infrastructure necessary to ensure them.
The article is devoted to a particular form of freedom of assembly — the right to counter-demonstrate. The author underlines the value of this right as an element of democratic society, but also acknowledges the risk of violent actions among participants of opposing demonstrations. Due to this risk, the government may adopt adequate measures restricting the right to counter-demonstrate, certain types of which are analyzed in this paper.
Development of standards of international controllability is reviewed in the article. Institutional approach is applied to development of international legal regime of Energy Charter. Definition of controllability is connected to development of international standards of dispute settlement, which are described in the article in detail. In connection with controllability, Russian interest, defense of investment in European Union and ecological investment encouragement, is reviewed in the article.
