Improving Workplace Quality. New Perspectives and Challenges for Worker Well-Being
The volume presents a selection of contributions mostly from the fourteenth annual conference in commemoration of Prof Marco Biagi on Wellbeing at and through work held in Modena (Italy) on 17–18 March 2016. The papers, which form the chapters in this volume, cover a number of countries and a wide range of issues in relation to quality of work and employee well-being including discrimination, harassment, disability, and work-life balance addressing them in an interdisciplinary perspective. Moreover, a number of regulatory approaches ranging from legislative interventions to voluntary measures are analysed in an attempt to cast light on the problem of well-being at work.
Article examines the case of Konstantin Markin, a military servant, who applied for the paid child care leave and was rejected due to the lack of regulation of this right in legislation on men - military servants. The case was considered by courts of general jurisdiction of Russia and by the Constitutional Court of Russian Federation, and then by the European Court on Human Rights. Due to the different understanding of norms on discrimination, CC of RF and ECHR came to different concusions. Article investigates how this conflict influenced Konstatin Markin, regulation of prohibition of discrimination in Russia and attitude of Russia towards ECHR decisions.
In this paper we examine satisfaction with work-life balance among non-standard workers. Using unique data from 6,009 Russian-language internet freelancers, who are typically both autonomous contractors and teleworkers, we make two key contributions. We found evidence to support the demand-resource model among self-employed professionals who typically have autonomy and control over their time, although these processes differ somewhat by gender. We also argue that overall life satisfaction is a significant influence on satisfaction with work-life balance and also acts as a mediator for the influence of some demands and resources on both male and female freelancers’ satisfaction with work-life balance. Implications for future research and social policy are discussed.
The article deals with the issues of Russian labour law compliance to the international labour standards in several crucial issues: discrimination in employment, freedom of association, wages etc.
Certain altruistic phenomena in the workplace that exceed the bounds of contract theory can be explained within the framework of gift exchange theory. We discuss the application of gift exchange theory to interactions between an employer and an employee as well as between employees themselves. We emphasize the opportunities of gifts to improve coordination and contract efficiency in the workplace and argue that there exists the productive function of gifts. We use the framework of a market for externalities in order to demonstrate that given the interrelated activities of agents a gift exchange between them can lead to Pareto improvement.
The article is devoted to a particular form of freedom of assembly — the right to counter-demonstrate. The author underlines the value of this right as an element of democratic society, but also acknowledges the risk of violent actions among participants of opposing demonstrations. Due to this risk, the government may adopt adequate measures restricting the right to counter-demonstrate, certain types of which are analyzed in this paper.
Development of standards of international controllability is reviewed in the article. Institutional approach is applied to development of international legal regime of Energy Charter. Definition of controllability is connected to development of international standards of dispute settlement, which are described in the article in detail. In connection with controllability, Russian interest, defense of investment in European Union and ecological investment encouragement, is reviewed in the article.
