Что написано пером, то исправлено судом. Дело о ректификации договора. Комментарий к решению Апелляционного суда Англии и Уэльса от 31 июля 2019 года по делу FSHC Group Holdings Ltd v. Glas Trust Corporation Ltd (Rev. 1) EWCA Civ. 1361
The article discusses the case of the English Court of Appeal, which resolved one of the most puzzling issues of English contract law. The question relates to the rules of application of the doctrine of rectification. Rectification is the correction of a written contract that contains an error, i.e. does not correspond to the intentions of the parties at its conclusion. The intricate rule formulated by the court in practice made it somewhat more difficult to prove the existence of such an error, and also narrowed the possibilities of appealing the decision of the court of first instance in such cases.
