The analysis of the new Russian law for the real right of building someone else’s land. The author emphasizes the relevance of law in modern Russian social and economic conditions, to explain the proposed introduction of the Civil Code provisions on the right of development for building a house. The author draws Comparative characteristics of a real right of building and construction lease liability law. The article contains an analysis of the advantages and disadvantages of the proposed draft law to amend the Civil Code provisions. Possible theoretical and practical problems of implementation of the right to development for the construction of an apartment building. The work is accompanied by a comparative analysis of similar legal structures of the European rule of law.
