The article addresses the issues of pre-trial and extra-judicial appeal, review of administrative affairs, identifies problems in the current legislative regulation, offered options for their solutions.
The ongoing transformations are closely interrelated. The so-called "regulatory guillotine" is designed to eliminate conflicting, redundant and outdated requirements that are subject to scrutiny by state control and oversight.
The article is about actual issues of administrative and judicial reforms, a number of important for understanding of the issue terms (legal process, the administrative process, administrative and procedural activities, administrative justice, administrative jurisdiction, administrative court proceedings, etc.) are revealed, various problems of administrative cases in the courts, and in pre-trial (court) order are considered. The new procedural act (the Code of Administrative Court Procedure) is also analyzed. A lot of attention is also paid to the issue of pre-trial damages.
The monograph is devoted to a comprehensive analysis of the modern transformations that have occurred in public administration and public service in recent years under the influence of socio-economic reforms. Along with doctrinal and legislative issues focusing on applied aspects of organization of the system of Executive authorities and their law-making activities, analyzing problems that occur in modern practice income and the civil service and settlement of conflict of interests in the civil service, offers possible solutions. The monograph will be of interest to researchers and practitioners, state and municipal officials, teachers, graduate students, students, as well as all those who are interested in the problems of public administration and public service.
In the history of modern Russian government transformations, one of thecentral events was the passing of Presidential Decree No 314 of March 9, 2004 “On the system and structure of federal executive bodies”, which noticeably changed the composition of government bodies and their responsibilities. In the following years there were a significant number of changes in the structures of the executive bodies. The article compares the initial and modern structure of the executive power, showing which ideas of the administrative reform -2003 proved to be viable, and which did not pass the test of practice.
Smoking is a problem, bringing signifi cant social and economic costs to Russiansociety. However, ratifi cation of the World health organization Framework conventionon tobacco control makes it possible to improve Russian legislation accordingto the international standards. So, I describe some measures that should be taken bythe Russian authorities in the nearest future, and I examine their effi ciency. By studyingthe international evidence I analyze the impact of the smoke-free areas, advertisementand sponsorship bans, tax increases, etc. on the prevalence of smoking, cigaretteconsumption and some other indicators. I also investigate the obstacles confrontingthe Russian authorities when they introduce new policy measures and the public attitudetowards these measures. I conclude that there is a number of easy-to-implementanti-smoking activities that need no fi nancial resources but only a political will.
One of the most important indicators of company's success is the increase of its value. The article investigates traditional methods of company's value assessment and the evidence that the application of these methods is incorrect in the new stage of economy. So it is necessary to create a new method of valuation based on the new main sources of company's success that is its intellectual capital.
